Staff recommends the City Council authorize acceptance of the 2017 Edward Byrne JAG Grant in the amount of $9,063.00 from the Bureau of Justice Assistance, and the execution of the attached 2017 Interlocal Agreement.

BACKGROUND:

The Cathedral City Police Department has been eligible and has applied for the Edward Byrne Memorial Assistance Grant program for the last several years.  This year, as in past years, several Riverside County law enforcement agencies were identified as “disparate funding” agencies.  This disparate allocation occurs when a city is allocated one and one half times (150 percent) more than the county, while the county bears more than 50 percent of the costs associated with prosecution or incarceration of the municipality’s Part 1 violent crimes.  A disparate allocation also occurs when multiple cities are collectively allocated four times (400 percent) more than the county, and the county bears more than 50 percent of the collective costs associated with prosecution or incarceration of each municipality’s Part 1 violent crimes.  Cathedral City has been identified as a disparate agency for this year. 

The funding identified for Riverside County is $59,449 and the funding for the other 12 municipalities is $351,942 for a total of $411,391.  The $411,391 amount is for Riverside County and the participating cities within the county.  This formula explains why Cathedral City and the twelve other cities in Riverside County were identified as disparate funding agencies.  The jurisdictions certified as disparate must identify a Fiscal Agent who will submit a joint application for the aggregate eligible allocation to all disparate municipalities.  The joint application must determine and specify the award distribution to each unit of local government and the purpose for which the funds will be used.  The cities and county agreed that the County of Riverside (Sheriff’s Dept.) would be the Fiscal Agent for 2017.  Riverside County has created an Interlocal Agreement for the twelve cities and the joint application for the disparate agencies. 

The identified funds for Cathedral City are: $10,070 less 10% ($1,007) to the County Sheriff’s Dept. for their role as Fiscal Agent and for managing the application process.  The remainder awarded to Cathedral City is $9,063. 

 

 

DISCUSSION:

The Cathedral City Police Department will purchase the following equipment with the 2017 Edward Byrne Memorial Justice Assistance Grant Program (JAG) funding allotment:

X26P Conducted Electrical Weapon, Model 11003 Yellow X26P CEW, class III LASER (The funding allocation will allow for a quantity of nine.)

The Cathedral City Police Department is a professional organization that maintains a mandate on utilizing “modern” technology - which translates to equipping its officers with industry-standard resources and equipment. CCPD has equipped its sworn officers with Conducted Electrical Weapons (CEW) as a less-than-lethal, force option for over 15 years.  CEW deployments represent a deadly force encounter prevented by a CEW-equipped officer.  CCPD’s goal of equipping all sworn officers with a CEW will reduce deadly-force encounters, reduce officer-injuries and reduce potential litigation. JAG Grant funds would allow CCPD to equip recently-hired police officers with a new CEW and enable the department to replace aging and/or inoperable equipment with new safety equipment.

 

 

FISCAL IMPACT:

The grant funding will allow for a revenue resource to purchase the identified equipment in the amount of $9,063.
