RECOMMENDATION:

Staff recommends the City Council authorize the City Manager to execute an Agreement for Grant of Easement (Easement) from Desert Water Agency (DWA) on the west bank of the Whitewater River north of Ramon Road as part of the construction and maintenance of the Cathedral City Whitewater River Bike Path.

BACKGROUND:
DWA is the owner of real property that includes an active well site and a portion of the Whitewater River Channel north of Ramon Road. DWA's property includes the west bank levee of the Whitewater River Channel where the Cathedral City Whitewater Bike Path (Bike Path) is being constructed. As part of the Bike Path Project, this approximately 250 foot by 30 feet wedge shaped easement needed to be acquired.
DISCUSSION:
This Easement from DWA is the last remaining property segment that needs to be acquired by the City's Bike Path Project. DWA has already executed the attached Easement on August 2, 2017 and Staff is requesting that the City Manager be authorized to execute the Easement prior to recordation.
FISCAL IMPACT:
No City funds will be expended to acquire this easement.
