BACKGROUND:

On February 11, 2015 the City Council discussed considering a possible City Ordinance requiring gender neutral restrooms in businesses under certain circumstances. Thomi Clinton, Director of Transgender Day of Remembrance (TDOR), led a discussion on the issue. As a result, Staff was directed to:

 

1. Conduct a survey of the local business community to gauge support for the installation/conversion to gender neutral restrooms.

2.  Define the associated costs of restroom conversions.

3.  Research and identify related ordinances in other communities.

4.  Research any future related changes to the California Building Code. 

 

 

DISCUSSION:

1. Under staff direction, working in conjunction with the Chamber of Commerce, a survey was conducted on the subject and the results are attached.

 

2. Staff researched the conversion process for existing single-user restrooms and found that the required signage range in price from less than $10.00 to as much as a $100.00. This implies that a simple conversion of existing single-user restrooms is minimal.

 

3. Staff also obtained several enacted ordinances from other communities related to the subject and several samples are attached.

 

4. There are draft proposed code changes for the upcoming 2016 California Building Code that are attached.

 

 

FISCAL IMPACT:

There are no costs associated with this discussion. The implementation of an ordinance would result in some associated costs to the city.
