Staff recommends that the City Council conduct second reading and approve an ordinance amending the Art in Public Places ordinance to increase the funding allowed for art education programs.

BACKGROUND:
Staff presented information to the Council during study session on February 25, 2015 regarding the Art in Public Places ordinance. As a result Council indicated that they would like to consider amendments to the ordinance. The ordinance was introduced and given first reading on March 11, 2015.
DISCUSSION:
The most significant change in the ordinance involves increasing the percentage of funds, which can be used for art education programs each year, from 5% of beginning fund balance to 10%. The provision to use the funds for art education programs is permissive, meaning the funds may be used for that purpose, but their use for such programs is not required.
In addition to the change allowing 10% of funds to be used for art education programs, the amended ordinance deletes references to construction of projects by the Redevelopment Agency, reflecting the RDA dissolution.
FISCAL IMPACT:
The amendment redistributes the amount of the fees that may be used for art education but has no effect on the total fee amount charged. The fees are paid by development and art fund expenditures have no effect on the general fund.
