TITLE:

Title

Access Rights to and from Ramon Road at Two Driveway Locations for the CP Logistics, LLC Project (Sunniva)

End

FROM:

John A. Corella, P.E. - City Engineer

RECOMMENDATION:

Recommendation

Staff recommends the City Council adopt a Resolution to restore access rights to and from Ramon Road at two locations: 1. to allow for a wider driveway and 2. to provide a new access point where abutter’s rights of access were previously dedicated by Parcel Map 31261.

Body

BACKGROUND:

In 2007, Parcel Map 31261 was approved for the creation of five (5) parcels located on the south side of Ramon Road and El Toro Road. Certain dedications were made for street purposes on this map, and abutter’s rights of access to Ramon Road were dedicated along the Ramon Road frontage of the new parcels. Two (2) forty-foot-wide access openings were allowed for future driveway access to the parcels. The parcels were never developed and remained vacant until Sunniva purchased and consolidated the land encompassing these access openings.

Sunniva has an approved cultivation facility development under construction as approved by Conditional Use Permit 2016-013. The approved Engineering Site Plan proposes two new and wider driveways to serve the Project, which must accommodate the turning movements of large trucks and trailers.

DISCUSSION:

There are two driveway access openings shown on the recorded Parcel Map 31261. This request will not create additional driveway openings, but will only shift the locations of the existing openings and widen them from 40 feet each, to 42 feet wide at the easterly opening, and 54 feet wide at the westerly opening, respectively. The property owner will dedicate or waive abutters rights to the City at the locations where the old access openings are no longer needed.

Staff is requesting that the City Council adopt a resolution authorizing (restoring) access rights to the portions of the Ramon Road frontage where the new driveways will be located. Upon adoption and recordation of this Resolution, property title will reflect this restoration of the access rights where the driveways are to be constructed.

As required by the Conditions of Approval, the owner is dedicating a street widening at the west end of the Ramon frontage to provide a right turn deceleration lane. The requested restoration of access rights at that location is a length of 191 feet. The new street dedication documents, however, will contain a waiver of the abutters rights along the entire length of the new right-of-way line, except at the proposed 54-feet wide driveway opening. The Resolution contains a condition which instructs the City Clerk not to record the Resolution until after the new street and abutters rights dedications have been made and accepted by the City.

FISCAL IMPACT:

Approval of the recommended action will not have a monetary impact to the City.
