RECOMMENDATION:
Recommendation
Staff recommends the City Council approve the Final Map of Tract No. 32858, subject to recordation within 180 days; and accept the offers of dedication made thereon, subject to improvement of these dedications; and approve the Subdivision Agreement for Tract No. 32858 and authorize its execution by the Mayor and City Clerk.

BACKGROUND:
Tentative Tract No. 32858 (TT 32858) was approved on February 9, 2005, for the construction of 52 single family units on a vacant parcel within the Rio Vista Project area. TT 32858 has been extended several times by State legislation and three times by the City Planning Commission pursuant to City Ordinance 659. TT 32858 will expire on February 9, 2017, as there are no more extensions available.
This area has been vacant for some time, and the land ownership has changed several times. Sol Recovery, LLC, (Subdivider) a subsidiary of Inland Communities Corporation acquired TT 32858 and has worked diligently to complete a Final Map for the subdivision.
DISCUSSION:
The Final Map has been submitted, checked and meets the Conditions of Approval for TT 32858; thus is ready for City Council approval.
The Subdivider has executed a Subdivision Agreement, secured with sufficient improvement securities in the form of corporate surety bonds. This Subdivision Agreement requires City Council approval, the signature of the Mayor and City Clerk.
The dedications to the City on the map include the public streets and alleys serving the Tract and a small pocket park in accordance with the Rio Vista Specific Plan. City Council is asked to accept the dedications on the map, subject to the improvement of the streets, alleys and pocket park.
Tract No. 32858 will be subject to the Master Covenants, Conditions and Restrictions of the Rio Vista Tract and will be annexed into the existing Homeowners Association.
The Subdivider must still post cash or security with the County Tax Collector as a guarantee of property tax payment before the map can be recorded. Therefore Council is asked to make the Final Map approval subject to the recordation of the Final Map with the County Recorder within 180 days of Council approval. This should be more than adequate time to process the Final Map through the County and will assure the City that the recordation of the Final Map will not be delayed.
