Body

BACKGROUND:

On September 3, 2014, Northgate Community Church received a Conditional Use Permit (CUP 14-004) to construct a new worship center located on the southeast corner of Date Palm Drive and 30th Avenue.

The project consists of a two-story building with a total area of 15,480 square feet. The ground floor has a total of 9,600 square feet and consists of the sanctuary where services are held, restrooms, classrooms, nursery, offices, and storage. The upper floor consists of classrooms and restrooms having a total area of 5,880 square feet. The proposed project will be constructed on approximately four acres of a larger six-acre property. The remaining two acres will be site graded and stabilized but will otherwise remain vacant.

On-site and off-site improvements for the project include the installation of streets lights on Date Palm Drive and 30th Avenue, construction of sidewalk along Date Palm Drive, connection to public sewer and water, and construction of a retention/drainage system for the site, garden walls and fellowship plaza.

The Construction of the worship center was estimated by the project architect at $1.5 million with additional on-site and off-site improvements estimated at $597,431. Accordingly, a grading permit was issued on November 12, 2014 which included a PM10 cash deposit of $12,000, and subsequently a building permit was issued on January 8, 2015 with building construction starting soon after.

DISCUSSION:

On May 5, 2015, the City received a letter from the project architect indicating that the Church had incurred a significant amount of unexpected costs associated with the project. As a result, the Church would like to request that a number of items be deferred (see attachment) and a Temporary Certificate of Occupancy be granted.  This would allow the Church to open and provide the time to raise the necessary funds to complete the project.

As a follow up, staff met with Pastor David Gilmore, representing Northgate Community Church, and the project Architect, Chris McFadden, and discussed the options and possible solutions that may be acceptable to the City.

Northgate Community Church is requesting that the City consider issuing a Conditional 12-month Temporary Certificate of Occupancy (TCO). The landscaping is currently underway and will be completed prior to TCO.  During the term of the TCO, Northgate would complete the remaining deferred items and as a security, the City would retain the $12,000 PM10 cash deposit.  A final Certificate of Occupancy would not be granted until all items are completed.

MPT Pettis requested this item be brought before the Council for a status update.

FISCAL IMPACT:

There is no fiscal impact to the City.
