Final Map and Subdivision Agreement - Stanton Place 2014 LLC
End
FROM:
Pat Milos, Community Development Director
RECOMMENDATION:
Recommendation
Staff recommends that the City Council approve the final map of Tract 36832-1; approve the subdivision agreement for Tract 36832-1; and authorize its execution by the Mayor and City Clerk.
Body
BACKGROUND:
Tentative tract 36832 was approved by the Planning Commission in December, 2014 for a 17 lot single family dwelling subdivision on vacant land on the north side of McCallum Way, west of Landau Boulevard.
This land is the site of former Tract 32309, which was a similar single family subdivision created by Landau Development Co., Inc., in 2006. This tract was never built out, and was reverted to acreage in 2011 after the death of the former president of Landau Development. The new tract is essentially a copy of Tract 32309, with the same number of lots and lot sizes, and same tract layout. The new sub-divider, Stanton Place 2014, LLC, has chosen to record this new map in two increments. This first map, Tract 36832-1, will create the first 4 lots of the 17, which will front on the south side of Elizabeth Road.
DISCUSSION:
A subdivision agreement for this first tract has been prepared and executed by the sub-divider, who has guaranteed performance by posting improvement securities as required by the State Subdivision Map Act, for faithful performance, labor and materials, and for placement of final monuments. No dedications are being made with this first map. When the new tentative map was approved, the Planning Commission approved an Environmental Determination which justified a CEQA Class 32 (In-Fill Development) Categorical Exemption for this project.
If sales of these lots progress well, the sub-divider intends to file another map increment and finish out the tract. This first tract has paid $6,373 in Quimby Act fees for parks, in accordance with Chapter 9.106 of the Municipal Code. This tract has already been annexed into the City Community Facilities District, and the lot buyers will be taxed annually for their proportionate share of the financial impact of the tract on City services.
All conditions of the tentative map have been met, and the final map meets the requirements of the State Subdivision Map Act and City codes. Staff therefore recommends that Council approve the final map, and approve the execution of the subdivision agreement.
FISCAL IMPACT:
Approval and recordation of the final map will allow construction of four (4) single family residences.
Ordinarily, the construction and occupancy of single family units would likely cause further fiscal constraints in the ability of the City of Cathedral City to meet expected demands for public services from the buyers and residents of this development. This is because City General Fund revenue expected from this tract is not likely to offset the actual costs of providing this development with such services as Fire, Paramedics, Police, and other services.
However, since the development is now included in the City-wide Community Facilities District, it is expected that the special tax generated by the CFD will help to offset any financial impacts caused by these demands.
