Body

BACKGROUND:
The City of Cathedral City is sponsoring a General Plan Amendment and Change of Zone to correct an inadvertent error from a past city-wide General Plan and zoning update (General Plan Amendment 02-78 and Change of Zone 02-100) approved by the Planning Commission and City Council in 2002.  At that time the two lots in question were rezoned from R1 (Single Family Residential) to NBP (Neighborhood Business Park); the corresponding General Plan Map was changed from RL (Low Density Residential) to BP (Business Park).  These two lots were mistakenly included in a commercial rezone of the northwest corner of Cathedral Canyon Drive and Dinah Shore Drive.

DISCUSSION:
These two adjacent lots, addressed at 33950 and 33972 Pueblo Trail (Assessor Parcel Numbers 680-441-021 and 022), are typical-sized single family lots for the area; the lot addressed at 33950 Pueblo Trail is vacant, and the lot addressed at 33972 Pueblo Trail is occupied with a single family residence.  Lots to the north and west are zoned R1, single family residential, and developed with residential uses.  The lot to the east is zoned, Neighborhood Business Park, and is developed with a 7-11 Convenience Store.  Lots to the south across Dinah Shore Drive are zoned RR, Resort Residential, and occupied by a residential community.

Approval of this request would return the lots to their original zoning designation of R1 (Single Family Residential) and general plan designation of RL (Low Density Residential), which would allow the vacant lot to be developed with a single family residence and would make the existing single family residence consistent and conforming with the underlying residential zoning.  The General Plan Map would also be changed to reflect the new designation of RL.

The request is supported by both property owners (attachment 6).
PLANNING COMMISSION ACTION

On October 1, 2014, the Planning Commission voted 6-0 to recommend approval of General Plan Amendment No. 14-003 and Change of Zone No. 14-002 to the City Council. The Cathedral City Planning Division of the Community Development Department is custodian of the documents or other material that constitute the record of proceedings upon which this decision is based.

FINDINGS

The Planning Commission recommended that the City Council take the following action:

•      Approve an exemption to the California Environmental Quality Act (CEQA) based on the finding that the project is exempt pursuant to Section 15061(b)(3), the "General Rule" since it has been determined that it would have no impact on the environment.

•      Approve General Plan Amendment No. 14-003, including the General Plan designation amendment and General Plan Map change, and Change of Zone 14-002, subject to the following findings:

1.      The proposed General Plan Amendment from BP (Business Park) to RL (Low Density Residential) and Change of Zone from NBP (Neighborhood Business Park) to R1 (Single Family Residential) are consistent with the established goals, policies and objectives of the General Plan;

2.      The proposed General Plan Amendment and Change of Zone is necessary and proper at this time, and is not likely to be detrimental to the adjacent property owners and/or residents;

3.      The proposed General Plan Amendment and Change of Zone, as shown on Exhibit A, would change the General Plan designation and zoning of the two parcels/lots at the northeast corner of Dinah Shore Drive and Pueblo Trail with the following APNs: 680-441-021 and 680-441-022; and

4.      The proposal is to correct an inadvertent error from a past city-wide General Plan and zoning update (General Plan Amendment 02-78 and Change of Zone 02-100), returning the subject parcels to their original zoning designation of R1 (Single Family Residential) and General Plan designation of RL (Low Density Residential).
