Body

BACKGROUND:

The City's Short-Term Rental Vacation Rental Ordinance, CCMC 3.24.011, was adopted by City Council in April of 2017 and became effective July 2017.  As a result, the City's Code Compliance Division was charged with monitoring and enforcement of the STVR Ordinance.

Code Compliance will be providing an update on the monitoring and inform the City Council of the actions taken and the trends identified concerning the STVR Ordinance.

DISCUSSION:

Staff began tracking STVR complaints and calls for service in April 2017. City Council approved a new position in the Code Compliance Division and that new officer has been tasked with compiling all STVR issues as well as being the primary responder for code violations stemming from the STVR operating in the City.

Since April 2017, after the adoption of CCMC 3.24.011, (through 8/13/17), the following statistics have been compiled:

353 -  #415 Music Calls received by CCPD

-24 calls were attributed to permitted STVR properties,

-10 properties were responsible for these 24 calls

-15 calls were attributed to non-permitted, expired or non-eligible STVR properties,

-4 properties were responsible for these 15 calls

33 - CadenceComm (Hotline) complaints received

-23 CadenceComm (Hotline) reported “noise” complaints

-4 CadenceComm (Hotline) reported “vehicle” complaints

-5 CadenceComm (Hotline) reported “No Business License/No Permit” complaints

-1 CadenceComm (Hotline) reported “advertisement violation” complaint

20 - GoRequest (App) complaints received

-8 GoRequest (App) reported “noise” complaints

-4 GoRequest (App) reported “vehicle” complaints

-4 GoRequest (App) reported “No Business License/No Permit” complaints

-4 GoRequest (App) reported “advertisement violation” complaints

1 - Telephone “noise” complaint received

Compliance Action Taken:

-6 citations were issued.

-19 notices were issued.

-3 complaints were unsubstantiated.

-1 property continues to be audited and is no longer eligible to operate per CCMC 3.24.11.D.3 (CC&R’s).

Challenges encountered thus far:

1. The Hotline is having difficulty reaching an owner, authorized agent or representative.

2. Noise complaints are difficult to authenticate; thus City Staff is relying on CCPD to verify on initial response.
