BACKGROUND:
The Applicant (Jose Aceves representing All Desert Appliance) submitted a Conditional Use Permit (CUP) application on September 26, 2017, and it was determined to be complete. The application is a request to operate a refurbished appliance store (retail store-used) within an existing multi-tenant commercial complex located at 67710 Ramon Road. The commercial complex is within the PCC (Planned Community Commercial) Zoning District.
The commercial complex is part of a self-storage facility located on two separate parcels, APNs 677-420-012 and 677-420-015 (see Attachment 2). The retail units, where the Applicant will be located, is within APN 677-420-012. The two parcels have six (6) buildings on a 3.09-acre parcel. The building with frontage on Ramon Road has 18 retail units with each having a storefront, rear storage space, and its own address. The remaining five (5) buildings are self-storage units.
There will be no exterior changes; therefore, no review from the Architectural Review Committee is needed. The Planning Commission will take final action on this matter unless it is appealed to the City Council.
ANALYSIS:
The proposed project (All Desert Appliance) is a conditional use as defined in the PCC Zoning District, which requires that any facility that sells used merchandise have a Conditional Use Permit (CUP). The Applicant proposes to sale refurbished appliances, which is included in the definition of “retail store-used” under Chapter 9.08 of the Cathedral City Municipal Code. The proposed facility will be located in an existing unit (67710 Ramon Road) within an existing multi-tenant commercial building. The unit is approximately 1,547 square feet with an approximately 134 square-foot office, 575 square-foot storage area and 834 square-foot showroom (see Attachment 3). Delivery of appliances will be done through the rear loading area where there are three (3) roll-up doors leading to the storage space (Attachment 5). The Applicant proposes no new construction and therefore, there is no conflict with the zoning standards for setbacks, building height, landscaping percentage, or total number of parking spaces.
The City requires a CUP for the sale of used merchandise in order to monitor the drop-off procedure, storage of materials, and other factors that may affect the site amenity or cleanliness. The sale or storage of any merchandise outside will be strictly prohibited with the exception of a special event, which may be permitted with the approval of a Special Use Permit.
In addition, Staff has placed Conditions of Approval 3.3 through 3.6 (see Attachment 1) regulating drop-off procedures, outdoor storage, outdoor repairs and the outdoor sale and/or display of merchandise.
ENVIRONMENTAL ANALYSIS:
Categorical Exemption under Section No. 15301, Class 1 (Existing Facilities) of the State CEQA Guidelines, which allows tenant improvements in existing buildings to be exempt. Since there is no outside expansion, this qualifies for a Class 1 Exemption.
NOTE: The City of Cathedral City Planning Department is custodian of the documents or other material, which constitute the record of proceedings upon which this decision is based.
