RECOMMENDATION:

Recommendation

Staff recommends the City Council accept the San Joaquin Sidewalk Improvements, CIP 2517 as final; and authorize the City Manager to file a Notice of Completion with the Riverside County Recorder’s office on behalf of the City Council; and authorize the release of City held retention funds to CT&T Concrete Paving upon expiration of the Notice of Completion.

Body

BACKGROUND:

Staff is requesting that the City Council accept and approve the San Joaquin Sidewalk Improvements, CIP 2517 (Project).  City Council acceptance is required to approve the Project’s final contract amount and release retention funds. Retention funds are monies earned by the Contractor that are withheld from progress payments pending satisfactory completion and final acceptance of the Project.  The Project was built according to the contract terms.

City Council acceptance is also required to file the formal Notice of Completion (NOC) with the Riverside County Recorder’s office.  The NOC is a written notice issued by the owner of a Project, or his/her agent, to notify concerned parties that all work on the project has been completed.  This notice also sets the period, which is 30 days from the date the NOC is filed, within which concerned parties may exercise their lien rights against one another.  Once the thirty day period has expired, and provided no claims or liens are received, the City can release retention funds.

DISCUSSION:

The City of Cathedral City executed a construction contract with CT&T Concrete Paving for the Project on June 8, 2016 for the contract bid amount of $143,100.00.

CT&T began the project work on July 26, 2016 and completed all the work required within the existing Cathedral City right-of-way per specification. The project is now ready for acceptance by City Council.

FISCAL IMPACT:

Contingency Funding:  Staff recommended, and Council approved an approximate fifteen percent contingency to cover unforeseen work or events during the project construction phase.  The approved amount was $21,500, making the total construction contract encumbrance amount $164,600.00. $5,400 was also approved to provide construction inspection and materials testing.  Additional sidewalk was constructed to complete missing links in the San Joaquin neighborhood. The additional work added $21,466.00 to the contract.  Inspection and testing costs total $2,811. Adequate funding is available to support the contract, contingency and inspection/testing.
