FROM:
John A. Corella, P.E. - City Engineer
RECOMMENDATION:
Recommendation
Staff recommends the City Council accept the Avenida La Paz and Avenida La Vista Pavement Rehabilitation Improvements, CIP 8655 as final; and authorize the City Manager to file a Notice of Completion with the Riverside County Recorder’s office; and authorize the release of City held retention funds to Matich Corporation upon expiration of the Notice of Completion.
Body
BACKGROUND:
Staff is requesting that the City Council accept and approve the Avenida La Paz and Avenida La Vista Pavement Rehabilitation Improvements, CIP 8655 (Project). City Council acceptance is required to approve the Project’s final contract amount and release retention funds. Retention funds are monies earned by the Contractor that are withheld from progress payments pending satisfactory completion and final acceptance of the Project. The Project was built according to the contract terms.
City Council acceptance is also required to file the formal Notice of Completion (NOC) with the Riverside County Recorder’s office. The NOC is a written notice issued by the owner of a Project, or his/her agent, to notify concerned parties that all work on the project has been completed. This notice also sets the period, which is 30 days from the date the NOC is filed, within which concerned parties may exercise their lien rights against one another. Once the thirty day period has expired, and provided no claims or liens are received, the City can release retention funds.
DISCUSSION:
The City of Cathedral City executed a construction contract with Matich Corporation for the Project on September 14, 2016 for the contract bid amount of $622,000.
Matich began the project work on January 3, 2017 and completed all the work required within the existing Cathedral City right-of-way per specification. The Project is now ready for acceptance by City Council.
FISCAL IMPACT:
Contingency Funding: Staff recommended, and Council approved an approximate ten percent contingency to cover unforeseen work or events during the project construction phase. The approved amount was $62,000, making the total construction contract encumbrance amount $684,000. $16,000 was also approved to provide construction inspection and materials testing. Changes to valve adjustment materials required by the Coachella Valley Water District (CVWD) resulted in the unit price per water valve increasing from $750 to $1025, which added $31,900 to the contract. This increase will be reimbursed by CVWD and there will be no increased cost to the City. Quantity adjustments, due to field conditions added an additional $7,529.88 to the Project contract. The final construction cost was $661,429.88. CVWD will reimburse the City $150,675 for valve adjustments resulting in a $510,754.88 net construction cost. Inspection and testing costs totaled $15,801.
Council previously approved CDBG funding in the current year Action Plan in the amount of $350,000 and allocated $350,000 from Assessment District 88-3.
