RECOMMENDATION:
Recommendation
Staff recommends the City Council accept the Ocotillo Park (formerly Whitewater Neighborhood Park) Project construction contract, under Capital Improvement Program Project No. 7012 as final; and authorize the City Manager to file a Notice of Completion with the Riverside County Recorder's office on behalf of the City Council; and authorize the release of the City held retention funds to the Contractor, C.S. Legacy Construction, Inc., upon the expiration of the Notice of Completion.
Body
BACKGROUND:
Engineering Staff is requesting that the City Council accept and approve the Ocotillo Park (formerly Whitewater Neighborhood Park) Project construction contract, Capital Improvement Program (CIP) Project No. 7012 (Project) as final. The City Council's acceptance is required to approve the Project's final construction contract amount and release the Contractor's withheld retention funds. The retention funds are monies earned by the Contractor that are withheld from the progress payments pending the satisfactory completion and final acceptance of the project. The project was built according to the terms of the construction contract.
City Council's acceptance is also required to file the formal Notice of Completion (NOC) with the Riverside County Recorder's office. The NOC is a written notice by the City to notify concerned and/or impacted parties that all the construction contract work on the Project has been completed. Once this NOC is executed and filed with the County Recorder a 30 day period starts in which concerned and/or impacted parties may choose to exercise their lien rights against one another. Once the 30 day period has expired, and provided no claims or liens are received, the City can release the retention funds to the Project's Contractor.
DISCUSSION:
The City of Cathedral City executed a construction contract with C.S. Legacy Construction, Inc. (Contractor) for the Project on September 25, 2014 for the contract bid amount of $2,499,241.00. California Proposition 84 grant funding (Grant) for the total amount of the construction contract was approved for the Project funding. The Contractor began the work on October 6, 2014 and completed all the work required for the Project per the construction contract documents. The Project is now ready for acceptance by the City Council.
FISCAL IMPACT:
The Contractor bid $2,499,241.00 for the original construction contract project scope of work. Quantity changes due to field conditions, change orders and extra work orders due additional funds available increased the contract by $540,151.30. Funding for the Contractor's portion of the Project was one hundred percent (100%) from the Grant, designated within the City CIP under budget account number 331-7012-8802 in the amount of $3,039,392.30 of the total Grant amount of $4,998,392.00.
The remaining $1,958,999.70 of the Grant funds, that are not being paid to the Contractor, have been approved by the City Council for: Contract contingency, construction inspection services, CVWD fees, Verizon costs, SCE costs, Grant coordination services, labor compliance services, soils inspection services, internal and external City support services for the Project and cooperative (Piggyback) purchasing of key Project components. A few of these piggyback purchases are still nearing completion and should be completed at the beginning of April 2016 and do not affect the filing of the NOC for the Project Contractor's construction contract.
