RECOMMENDATION:

Recommendation

Staff recommends that the City Council approve the City of Cathedral City’s contribution to the Fiscal Year 2015-2016 Cost-Sharing Implementation Agreement (IA) for the Whitewater River Region.

Body

BACKGROUND:

On August 14, 2013, the City Council approved an amendment to the Implementation Agreement.  This Agreement served as an interim agreement until the new National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Permit was adopted.  The current NPDES MS4 Permit was adopted June 23, 2013 and went into effect on June 20, 2014 when the Stormwater Management Plan (SWMP) was approved by the California Regional Water Quality Control Board.  The approved Implementation Agreement replaced the interim agreement and is in effect until 2018.

DISCUSSION:

On May 6, 2014, the County of Riverside and Riverside County Flood Control and Water Conservation District (RCFCD), in cooperation with the Coachella Valley Water District (CVWD) and incorporated cities, including the Cities of Banning, Cathedral City, Coachella, Desert Hot Springs, Indian Wells, Indio, La Quinta, Palm Desert, Palm Springs, and Rancho Mirage, jointly established a provision for cost-sharing through an Implementation Agreement (IA). The cost-sharing provision funds public education, monitoring, cooperative agreement preparations and consulting services.

Under the NPDES MS4 permit, municipalities are required to enter into an IA with the agencies that manage the regional and local stormwater facilities. The Agreement between the aforementioned co-permittees establishes the fiscal responsibilities of each party concerning compliance with the NPDES MS4 Permit.

FISCAL IMPACT:

The cost of the stormwater programs administered by the RCFCD for the Whitewater River Region NPDES is estimated to be $300,851.24.  Based on current population, the City of Cathedral City’s share is $27,530.40. Please note that the cost-sharing agreement entered into by Cathedral City is considerably less costly as opposed to electing not to share costs with the other permittees.
