RECOMMENDATION:
Recommendation
Staff recommends that the City Council adopt a resolution approving Program Supplemental Agreement No. 017-N to the Administering Agency-State Master Agreement for Federal Aid, No. 08-5430R between the City of Cathedral City and the State of California, acting through the Department of Transportation, for the purpose of administering and disbursing federal funds for construction of the East Palm Canyon Drive Preventive Maintenance project; and authorize the City Engineer to sign Program Supplemental Agreement No. 017-N.

BACKGROUND:
The City of Cathedral City currently has a master agreement for the administration of federally funded projects within the City.  Specific projects are identified by program supplements to the Master Agreement.
Program Supplemental Agreement No. 017-N creates a mechanism to allow for reimbursement to Cathedral City for a portion of the costs for the East Palm Canyon Drive Preventive Maintenance Project.
Caltrans has requested that a certified, authorizing resolution be returned with the signed agreement for their further processing.  The Resolution should clearly identify the project and the official authorized to execute the agreement.  The Resolution must be returned to Caltrans as soon as possible to avoid dis-encumbrance and/or de-obligation of the funds.
DISCUSSION:
Cathedral City must have an approved Program Supplemental Agreement to receive reimbursement for project expenses. Program Supplemental Agreement No. 017-N is necessary for the City to be reimbursed for the construction of the East Palm Canyon Drive Preventive Maintenance Project.  Each specific project is given a Supplement Number as an identifier of the project and for the control of project funding.  The Program Supplement is viewed by Caltrans as an amendment to the Master Agreement.

The bid opening for the project was held on February 19 and the contract will be awarded on March 11 with anticipated construction completion by May 1.
FISCAL IMPACT:
The supplemental agreement creates a mechanism for the reimbursement of $336,680 of the total estimated cost of $380,300 to construct the improvements. The remaining estimated cost of $43,620 would be funded with funds from Gas Tax and/or Measure A.
