Body

BACKGROUND:

Ordinance No. 48 Establishing a Mobile Home Fair Practices Commission was approved by the vote of the people at a Special Election held on March 8, 1983.  This Ordinance is attached for your information.  At the time the Ordinance was adopted it was felt necessary to establish a Mobile Home Fair Practice Commission to protect the residents of mobile homes from excessive changes in rental rates and unreasonable changes in park rules and regulations while simultaneously recognizing and providing for the needs of park owners to receive a just and reasonable return on the present fair market value of their property.

Ordinance 48 is only applicable to mobile home parks located within Cathedral City and to those rental spaces in a mobile home parks which are located entirely within the Cathedral City limits.  This Ordinance does not apply to those parks located on tribal land.  There are currently only a few mobile home parks within the City limits that this Ordinance would apply to.

The Ordinance sets forth a maximum rent increase and the computation of the allowed increase.  A hardship rent increase is allowed upon approval of the Commission.  It also outlines the establishment of the Commission, their powers and duties, the initiation of Commission Proceedings, the conduct of the Commission Proceedings, Remedies, the Effect on Local Law, Retaliation, Mandatory Procedure, and Priorities - Timeless of Proceedings.  Ordinance No. 48 can only be amended by the vote of the people.

The Commission has adopted Rules and Regulations based on the adopted Ordinance, which are also attached for your information.

In recent years the Commission has not had a need to meet, there have been no hearings heard since approximately 2010.

DISCUSSION:

In the past few months there has been discussion between the owner of a mobile home park and staff.  It was indicated that an application for a hardship rent increase would be submitted to the Commission for consideration.  To date staff has not received this application, however, in an effort to be prepared Council has temporarily appointed four individuals to serve as the Mobile Home Fair Practices Commission.
