Staff recommends the City Council approve the CVAG model resolution implementing the provisions of SB 1193 requiring public notices regarding human trafficking.

BACKGROUND:
In February of 2015 the Coachella Valley Association of Governments Public Safety Committee discussed Anti-Human Trafficking and a presentation was given by Attorney Michael Harrington. Through further research by Attorney Harrington and the Riverside County Anti-Human Trafficking Task Force (RCHAT), under the Riverside County Sheriff’s Department, attention was brought to SB 1193.
SB 1193 legislation passed in September 2012. This legislation added section 52.6 to the California Civil Code creating a legal requirement for certain types of businesses to display public notices on slavery and human trafficking. Pursuant to this new law, these human trafficking notices must now be displayed in a conspicuous place, either near the public entrance or in a location in plain view of both the public and employees. These posters are required at the following types of business establishments:
• Adult or sexually oriented businesses
• On-sale general public premise licenses under the Alcoholic Beverage Control Act
• Airports
• Passenger rail or light rail stations
• Bus Stops
• Truck Stops
• Emergency rooms within acute care hospitals
• Farm labor contractors
• Privately operated job recruitment centers
• Roadside rest areas
• Businesses that offer massage or bodywork services
RCHAT has created a poster that meets all the requirements of SB 1193. As a public service, the Riverside County Sheriff’s Department has made the SB 1193 compliance poster available for download to the public.
On September 28, 2015 the Coachella Valley Association of Governments Executive Committee adopted Resolution No. 15-004 implementing SB 1193 Human Trafficking Public Notices as well as recommended that CVAG member jurisdictions consider adopting a Resolution doing the same.
DISCUSSION:
The City Manager received a letter from CVAG in early October reporting the action of the Executive Committee and requesting that Cathedral City consider adopting their Model Resolution implementing SB 1193. Cheryll Dahlin, Management Analyst, CVAG made a presentation to Council in study session on 11-16 and Council directed staff to bring the resolution forward for approval.
FISCAL IMPACT:
There is no fiscal impact with this item.
