TITLE:
Title
CDBG Annual Action Plan Amendments
End
FROM:
Pat Milos, Community Development Director
RECOMMENDATION:
Recommendation
Staff recommends that the City Council hold a public hearing and approve the substantial amendments to the Fiscal Years (FYs) 2013 - 2014 and 2014 - 2015 Annual Action Plans for submittal to U.S. Department of Housing and Urban Development (HUD) and authorize the City Manager or his designee the authority to submit the substantial amendments to the U.S. Department of Housing and Urban Development (HUD) for their review and record.
Body
BACKGROUND:
Each year, the City submits to the U.S. Department of Housing and Urban Development (HUD) a One-Year Action Plan that describes the activities and the financial resources it will use to meet the City's affordable housing and community development needs.
When a substantial change (programmatic or financial) is proposed to any activity within the Annual Action Plan, HUD requires the City to conduct a public hearing to allow the public an opportunity to comment on the proposed substantial change.
DISCUSSION:
The City proposes to substantially amend its 2013-2014 and 2014-2015 Annual Action Plans to reprogram Community Development Block Grant funds in the following ways:
Fiscal Year 2013 - 2014
Include the South City Street Improvements project in the plan and reprogram $327,817 in Community Development Block Grant (CDBG) funds from the Date Palm/Varner Road Improvements project to the South City Street Improvement Project. The Date Palm/Varner Road project was determined to be ineligible for CDBG funding due to its census tract not meeting income requirements.
Fiscal Year 2014-2015
Reprogram $322,488 in Community Development Block Grant (CDBG) funds from the South City Street Improvement Project to the Corregidor Drive and San Joaquin Drive Street Improvement Project.
These proposed substantial amendments to the 2013-2014 and 2014-2015 Annual Action Plans will allow for adjustments to the Annual Action plans so that these projects are properly accounted for in the appropriate Fiscal Year in which the federal funds were made available and reprogram dollars to new activities that were not previously mentioned in these plans.
ENVIRONMENTAL ANALYSIS:
In accordance with 24 CFR 58 of the National Environmental Protection Act (NEPA), each project assisted with federal funds must be evaluated to determine whether they are subject to environmental regulations. The environmental review of the FY 2013-2014 South City Street Improvements was approved on April 24, 2014 by HUD. The environmental review of the FY 2014-2015 Corregidor Drive Street Improvements and San Joaquin Drive Street Design Projects are currently underway.
PUBLIC NOTIFICATION:
When a substantial change (i.e. adding an activity, canceling an activity or redirecting funds) is proposed to the City Action Plan, HUD requires that the public be notified and a public hearing be held to allow the public an opportunity to comment on the proposed substantial changes. City staff published a public notice announcing these amendments in the November 3rd edition of the Desert Sun. The public notice period ran from November 3, 2014 through December 10, 2014. During this public notice period, City staff did not receive any comments from the public regarding the proposed substantial amendments to the FY 2013-2014 and 2014-2015 Annual Action Plans.
CONCLUSION:
The approval of the proposed substantial amendments to the FY 2013-2014 and 2014-2015 Annual Action Plans will allow the City to improve the condition of streets and sidewalks located in income-eligible neighborhoods within the City.
FISCAL IMPACT:
Approval of this substantial amendment will have no adverse fiscal impact to the City's General Fund. The City will redirect $322,488 in Community Development Block Grant (CDBG) funds that were originally designated for the South City Street Improvement Project to the Corregidor Drive Street Improvement Project and the street and sidewalk design of San Joaquin Drive. In addition, $327,817 in FY 2013-14 CDBG funds from the Date Palm/Varner Road Improvements project were redirected to the South City Street Improvement Project.
