APPROVAL OF CONDITIONAL USE PERMIT NO. 17-041, subject to the attached conditions of approval, and based on the following findings:

1. The used goods retail store, which is located at 33785 Date Palm Drive in the PCC (Planned Community Commercial) Zoning District and Specific Plan No. 87-26, is authorized as a conditional use per the City of Cathedral City Zoning Ordinance, Chapters 9.30 and 9.72, and Specific Plan No. 87-26;

BACKGROUND:

The Applicant (Bonnie Moser Guerra representing R & B Resale Shop) submitted a Conditional Use Permit (CUP) application on November 14, 2017, and it was determined to be complete. The application is a request to operate a used goods retail store within an existing multi-tenant commercial building located at 33785 Date Palm Drive, Suite B. The commercial building is within the PCC (Planned Community Commercial) Zoning District and Specific Plan No. 87-26.

The commercial building is located on a 0.4-acre “L”-shaped lot on the southwest corner of Date Palm Drive and Olancha Road (see Attachment 2). The approximately 1,648 square foot building has two (2) suites and the used goods retail store will be in suite B (the northerly suite). The primary entrances to the suites are located on the rear (west side) of the building facing the parking lot (see Attachment 5). The building and the parking lot are accessed through a driveway along Olancha Road (see Attachment 6).

There will be no exterior changes; therefore, no review from the Architectural Review Committee is needed.  The Planning Commission will take final action on this matter unless it is appealed to the City Council.

ANALYSIS:

The proposed project (R & B Resale Shop) is a conditional use as defined in the PCC Zoning District, which requires that any facility that sells used merchandise have a Conditional Use Permit (CUP). The Applicant proposes to sell used items such as household goods, jewelry and music equipment. The proposed facility will be located in Suite B of the existing commercial building. The suite is approximately 1,000 square feet which includes two (2) showroom areas and a bathroom (see Attachment 3). The Applicant proposes no new construction and therefore, there is no conflict with the zoning standards for setbacks, building height, landscaping percentage, or total number of parking spaces.

The City requires a CUP for the sale of used merchandise in order to monitor the drop-off procedure, storage of materials, and other factors that may affect the site amenity or cleanliness. The sale or storage of any merchandise outside will be strictly prohibited with the exception of a special event, which may be permitted with the approval of a Special Use Permit.

In addition, Staff has placed Conditions of Approval Nos. 3.2 through 3.5 (see Attachment 1) regulating drop-off procedures, outdoor storage, outdoor repairs and the outdoor sale and/or display of merchandise

Specific Plan 87-26

The Specific Plan was originally adopted in 1989 and has been amended multiple times, most recently in 2007. The base zone of the Specific Plan is PCC (Planned Community Commercial) and includes development standards for new development as well as provisions for maintaining and allowing residential development. Additionally, specific uses such as fast food restaurants and automotive service stations are prohibited within the Specific Plan area. A used goods retail store is a conditionally permitted use in the PCC zoning district is not one of the prohibited uses listed in the Specific Plan. Therefore, the project is in compliance with the Specific Plan.

ENVIRONMENTAL ANALYSIS:

Categorical Exemption under Section No. 15301, Class No. 1 (Existing Facilities) of the State CEQA Guidelines, which allows tenant improvements in existing buildings to be exempt.  Since there is no outside expansion, this qualifies for a Class No. 1 Exemption.

NOTE: The City of Cathedral City Planning Department is custodian of the documents or other material, which constitute the record of proceedings upon which this decision is based.

PUBLIC NOTIFICATION:

This project and the environmental determination were noticed in accordance with the City Municipal Code and CEQA (see Attachment 4).
