RECOMMENDATION:

Recommendation

Staff recommends the City Council adopt the attached ordinance allowing cash transactions at medical marijuana dispensaries and requiring seed to sale software be utilized.

Body

BACKGROUND:

At the August 12, 2015, meeting, our office presented the City Council with both a proposed ordinance to reverse the current ban on cash transactions at medical marijuana dispensaries, and with a second ordinance to allow marijuana kiosks within the City in lieu of allowing cash transactions.

Following the City Council’s discussion, it directed the ordinance allowing cash transactions be brought back with the additional requirement that software be utilized to allow for tracking of all marijuana product from “seed to sale.”

The proposed ordinance, which is attached, makes the following changes to the Municipal Code:

1.                     The following language is deleted from the ordinance: “All transactions between the dispensary’s related cooperative or collective and its members or the members’ primary caregivers shall be made by personal check or credit card; no cash transactions shall be allowed.”

2.                     The following provision is added to the ordinance: “The dispensary shall be required to utilize software approved by the City Manager or designee that tracks all marijuana from the time of planting through sale (seed to sale).”

3.                     The ordinance is scheduled to sunset six (6) months after its effective date unless extended by an affirmative act of the City Council.

If adopted by the City Council, the ordinance will go into effect thirty (30) days after its second reading, or on October 9, 2015.
